Termination

Any body or agency, whether national or international, governmental or non governmental, that is qualified in matters covered by this Protocol and that has informed the Secretariat of its wish to be represented at a meeting of the Conference of the Parties serving as a meeting of the Parties to this Protocol as an observer, may be so admitted, unless at least one third of the Parties present object.

Where such settlement is reached, implementation of this Agreement shall resume and the amount of the financial contribution shall be reduced proportionately and pro rata temporis in accordance with the period during which implementation of this Agreement was suspended.

Suspension of the Agreement shall be notified to the other Party in writing and shall take effect three months after receipt of the notification.

The present Convention shall be open indefinitely for accession.

The withdrawal of these declarations shall not have any effect on contracts already concluded.

In the event of termination of the Protocol under circumstances other those provided for in Article 8, the party concerned shall notify the other party in writing of its intention to terminate the Protocol at least four (4) months before the date on which such termination would take effect.

Amendments

Article 14

For the purposes of the consultations referred to in paragraphs 1 and 2, each Contracting Party shall inform the other Contracting Party of any developments which could affect the proper functioning of this Agreement.

This includes any relevant agreement between one of the Contracting Parties and a third State.

Each Competent Authority of a Member State or Andorra will immediately notify the other Competent Authority, i.e. that of Andorra or that Member State, respectively, regarding any breach of confidentiality, failure of safeguards and any sanctions and remedial actions consequently imposed.

For the purposes of this paragraph, significant non compliance includes, but is not limited to, non compliance with the confidentiality and data safeguard provisions of this Agreement, a failure by the Competent Authority of a Member State or Andorra to provide timely or adequate information as required under this Agreement or defining the status of Entities or accounts as Non Reporting Financial Institutions and Excluded Accounts in a manner that frustrates the purposes of this Agreement.

Decisions taken by the Regional Steering Committee under this procedure shall respect the case law of the Court of Justice.

Where such settlement is reached, implementation of this Protocol shall resume and the amount of the financial contribution referred to in Article 4 shall be reduced proportionately and pro rata temporis according to the period during which implementation of this Protocol was suspended.

The notifications shall be made by diplomatic notes.

The annexes to this Agreement are an integral part of it.

The denunciation shall take effect 12 months after the receipt of the instrument of denunciation.
