As to the bidding costs, the tenderers will have access to an arbitration proceeding for the recovery of those costs.

The Panel of Experts shall issue its report to the Parties, in accordance with the relevant procedures set out in Chapter 14 (Dispute Settlement) of Title V (Trade and Trade related Matters) of this Agreement.

The follow up to the report and the recommendations of the Panel of Experts shall be monitored by the Trade and Sustainable Development Sub Committee.
