The Panel of Experts may seek information and advice from either Party, the domestic advisory group(s) or any other source it deems appropriate.

Effect of an arbitration agreement

If the last day for delivery of a document falls on a legal holiday of Colombia, Peru or of the EU, the document may be delivered on the next business day.

The Panel of Experts shall issue its report to the Parties, in accordance with the relevant procedures set out in Chapter 14 (Dispute Settlement) of Title V (Trade and Trade related Matters) of this Agreement.

The follow up to the report and the recommendations of the Panel of Experts shall be monitored by the Trade and Sustainable Development Sub Committee.

Consultations, in particular all information disclosed and positions taken by the Parties during the consultations, shall be confidential, and without prejudice to the rights of either Party in any further proceedings.

The mediator shall allow the Parties 15 days to comment on the draft report.

The Parties agree, to the extent necessary, to take joint action on, and to encourage, the adoption of further simplification measures.

SECTION 1 OBJECTIVE AND SCOPE

The Parties shall update published resources, including websites, containing such measures, on a regular basis and make them readily available to interested persons.

No law, regulation, decree, decision or administrative ruling of general application of the Parties pertaining to or affecting any matter governed by this Title shall become effective prior to publication.

During consultations each Party shall provide sufficient factual information, so as to allow a complete examination of the manner in which the measure at issue could affect the operation and application of this Agreement.

Such decisions shall be adopted by the Special Committee according to its procedures.

The proceedings involving mediation, in particular all information disclosed and positions taken by the Parties during these proceedings, shall remain confidential.

The request for the establishment of an arbitration panel shall be made in writing to the Party complained against and the Trade and Development Committee.
