With respect to paragraph 2 of Article 2, information is to be exchanged between San Marino on the one hand and all Member States, except Austria, on the other, with respect to 2016 and all subsequent years and will be exchanged within nine months of the end of the calendar year to which the information relates.

In respect of a dispute concerning emergency situations as defined in point (h) of Article 138 either Party may request the chairperson of the arbitration panel to act as conciliator concerning any matter related to the dispute by making a request to the arbitration panel.

In cases of urgency the arbitration panel shall make every effort to deliver its interim report within 45 days and, in any case, no later than 60 days after the date of establishment of the arbitration panel.

For the purposes of the exchange of information provided for in Article 2, the information exchanged shall identify the currency in which each relevant amount is denominated.

With respect to Article 2(2), the information to be exchanged for 2017 and all subsequent years shall be exchanged within nine months after the end of the calendar year to which the information relates.

The Chairperson of the Trade and Development Committee, or her or his delegate, shall select the arbitrators within five (5) days of receipt of the request made by either Party referred to in paragraph 3 and in the presence of a representative of each Party.

Such request shall be notified simultaneously to the Party complained against and to the Trade and Development Committee.

The arbitration panel may give a preliminary ruling within ten (10) days of its establishment on whether it deems the case to be urgent.

In cases of urgency, including those involving perishable and seasonal goods, the arbitration panel shall notify its ruling within forty five (45) days of the date of the receipt of the request.

The Parties shall take into account the activities of relevant multilateral environmental organisations or bodies so as to promote greater cooperation and coherence between the work of the Parties and these organisations or bodies.

If appropriate, it shall seek the advice of the Parties' civil society organisations through the consultative mechanisms referred to in Article 24.13.5.
